What’s at Stake

The Supreme Court’s decision in U.S. v. Skrmetti will set legal precedent around whether state governments can ban access to medically necessary care for transgender youth. This case challenges Tennessee’s SB1, a law that prohibits hormone therapy for trans minors — despite its wide endorsement by medical and psychological associations across the nation.

The Court will weigh two critical questions:

  • Does SB1 discriminate on the basis of sex or transgender status? The plaintiffs argue it does, as it bans treatment for trans youth that is allowed for cisgender youth.
  • Should this case be evaluated under heightened scrutiny? If so, the state must prove a compelling interest — something no court has yet upheld for these bans.

This case could either reinforce or dismantle the legal framework protecting trans youth nationwide. Over 25 states have introduced or passed similar bans. What happens in this case affects the future of trans rights, bodily autonomy, and equal protection under the law across the U.S.

Flags for Trans Futures: Each flag represents one transgender youth in Kentucky—standing for dignity, hope, and the right to thrive.

Installation Details

Number of Flags: 3,500 small transgender pride flags (approx. 5″ x 8″) — each representing one trans youth aged 13–18 in Kentucky.

Locations: Seven sites across the state — including civic, nonprofit, and private properties — will host coordinated installations. Final sites will be shared following the Supreme Court decision.

Timing: The installation will occur the first Saturday following the Court’s decision (expected between late June and early July 2025).

Duration: Each installation will remain in place for one week, after which volunteers will respectfully remove and recycle the materials.

Community Care: The displays are peaceful, affirming, and non-disruptive — designed to honor trans lives and preserve the dignity of public space. Local youth, families, and allies are invited to help install the flags and share their stories.

Educational Materials: QR-coded signage at each site will link to resources about the Skrmetti case, trans healthcare, and how to take action in support of LGBTQ+ youth.
